This bill has been introduced this year 2006 without last years strengthening clause that protects property owners.

Red indicates Senate Republican on the chart.SYNOPSIS: Under existing law, a municipality may zone territory only within the corporate limits of the municipality. There is no provision for zoning territory that is proposed to be annexed into the municipality. This bill would authorize municipalities to pre-zone territory proposed for annexation into the municipal corporate limits by following the provisions of Article 4 of Chapter 52 of Title 11, Code of Alabama 1975. The zoning would be effective only if the territory is annexed into the municipality. The bill also would specify that if property zoned pursuant to this provision is annexed into the municipality, all municipal services would be provided within 10 years.Have an opinion about this bill?

FISCAL NOTE
Senate Bill 12 as introduced could increase the obligations of municipalities choosing to pre-zone territory prior to annexation by an undetermined amount to provide all municipal services to such annexed areas within 10 years following annexation unless the municipality made public notice that such services may not be available prior to annexation.
