Under existing constitutional and statutory provisions, the boundaries of the state are described.  This bill, conditional upon the adoption of a constitutional amendment repealing Article II of the Constitution of Alabama of 1901, would amend and repeal these statutory provisions to provide further for the description of the boundaries of this state.  Under the existing Constitution, the boundaries of the several counties were ratified and confirmed. This bill, conditional upon the adoption of a constitutional amendment repealing Article II of the Constitution of Alabama of 1901, would ratify and confirm the boundaries of the several counties of the state currently existing and the locations of county courthouses.

 

A BILL

TO BE ENTITLED

AN ACT

 

Describing the boundaries of the state; amending Section 41-2-1 and repealing Sections 41-2-2, 41-2-3, and 41-2-4 of the Code of Alabama 1975; ratifying and confirming the boundaries of the several counties as they now exist and the locations of county courthouses; and conditioning effectiveness upon the adoption of a constitutional amendment.

 

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

 

Section 1. Section 41-2-1 of the Code of Alabama 1975, is amended to read as follows:

 

§41-2-1.

 

"The boundaries of this state are established and declared to be as follows: Beginning at the point where the thirty-first degree of north latitude crosses the Perdido river; thence east to the western boundary line of the state of Georgia; thence along said line, to the southern boundary line of the state of Tennessee; thence west along the southern boundary line of the state of Tennessee, crossing the Tennessee river, and on to the second intersection of said river by said line; thence up said river to the mouth of Big Bear creek; thence by a direct line to the northwest corner of Washington county, in this state, as originally formed; thence southerly along the line of the state of Mississippi to the Gulf of Mexico; thence eastwardly, including all islands within six leagues of the shore, to the Perdido river; and thence up the said river to the beginning. The boundaries of this state are established and declared to be as follows: Beginning at the point where 30 degrees 16 minutes 53 seconds of north latitude crosses the Perdido River; thence east, to the western boundary line of the State of Georgia; thence along said line to the southern boundary line of the State of Tennessee; thence west, along the southern boundary line of the State of Tennessee, crossing the Tennessee River, and on to the second intersection of said river by said line; thence up said river to the mouth of Big Bear Creek; thence by a direct line to the northwest corner of Washington County, in this state, as originally formed; thence southwardly, along the line of the State of Mississippi, to the Gulf of Mexico; thence southwardly to the intersection of the offshore Federal/State boundary as fixed by decree of the U.S. Supreme Court; thence eastwardly along said fixed line to the intersection of the State of Florida boundary; thence northwardly along the State of Florida boundary to the Point of Beginning; provided, that the limits and jurisdiction of this state shall extend to and include any other land and territory hereafter acquired, by contract or agreement with other states or otherwise, although such land and territory are not included within the boundaries hereinbefore designated."

 

Section 2. Sections 41-2-2, 41-2-3, and 41-2-4 of the Code of Alabama 1975, relating to the boundaries of the state, are repealed.

 

Section 3. The boundaries of the several counties of this state, and the locations of county courthouses, as they exist on the effective date of this act, are ratified and confirmed.

 

Section 4. This act shall become effective following its passage and approval by the Governor, or its otherwise becoming law, if and on the date that a constitutional amendment repealing Article II of the Constitution of Alabama of 1901 is ratified by the electors of this state.
